Al onze diensten en verrichtingen geschieden op basis van de Algemene Belgische Expeditie Voorwaarden 2005, gepubliceerd in de bijlage tot het Belgisch Staatsblad d.d. 24 juni 2005 onder nr. 0090237 ( de “Algemene Voorwaarden”).
Deze Algemene Voorwaarden werden u per aangetekend schrijven toegestuurd of in het ontkennend geval worden deze u bij eenvoudig verzoek gratis opgestuurd. Bij elke geschreven prijsofferte wordt hiervan eveneens melding gemaakt.
Wanneer u gebruik maakt van de diensten van Flightwatch wordt u verondersteld akkoord te gaan met deze Algemene Voorwaarden.

1. Alle facturen zijn contant betaalbaar te Oostende.

2. Vanaf de vervaldag van de factuur en zonder rappel of ingebrekestelling zal van rechtswege een intrest van 12% per jaar beginnen lopen, en dit tot de volledige betaling.
   Daar bovenop zal bij laattijdige betaling een forfaitaire schadevergoeding van 12% van het bedrag van de factuur verschuldigd zijn, met een minimum van 250,00 EUR.
   De intresten en forfaitaire vergoeding zijn verschuldigd zonder afbreuk te doen aan de toepasselijkheid van de wet van 2 augustus 2002 (gewijzigd door de wet van 22 november 2013) betreffende de bestrijding van de betalingsachterstand bij handelstransacties (Gepubliceerd in de B.S. op 07.08.2002 en 10.12.2013).

3. Elke klacht over deze factuur moet ter kennis gebracht worden aan Flightwatch per aangetekende brief, binnen 5 dagen na dagtekening van deze factuur.
   Elk geschil betreffende de vervoerders, facturen of betalingen in verband met enig uitgevoerde prestatie, dient uitsluitend onderworpen aan de Rechtbanken van het gerechtelijk arrondissement Oostende.

Tous les services et opérations effectués par Flightwatch se font sur base des Conditions Générales belges d’expédition 2005. Le texte a été publié à l’annexe au Moniteur Belge du 24 juin 2005 sous le no 0090237 (“Les Conditions Générales”) et vous a été  envoyé par courrier recommandée ou vous sera envoyé gratuitement sur première demande. Les Conditions Générales sont aussi mentionnées sur chaque offre écrite.
   Chaque fois que vous utilisez les services de Flightwatch vous êtes d´accord avec ces Conditions Générales.

2. Toutes les factures sont payables à Ostende.

3. A l’échéance de la facture et sans rappel de paiement ni mise en demeure, un intérêt au taux de 12% l’an prendra cours de plein droit jusqu’à paiement intégral de son montant. 
   En plus des intérêts de retard, il sera dû une indemnité forfaitaire de 12% du montant de la facture, avec un minimum de € 250,00, à titre de dédommagement forfaitaire pour frais administratifs supplémentaires, surveillance de débiteurs et perturbations commerciales.
   Les intérêts et l’indemnité forfaitaire seront dus sans préjudice de l’application de la loi du 2 août 2002 (modifiée par la loi du 22 novembre 2013) concernant la lutte contre le retard de paiement dans les transactions commerciales (Publications au M.B. du 07.08.2002 et 10.12.2013).

4. Chaque plainte doit être communiqué à Flightwatch par courrier recommandée, dans les 5 jours après date de facture.
   En cas de litige, les tribunaux de l’arrondissement judiciaire de Ostende seront seuls compétents. 

1. All services and transactions perfomed by Flightwatch are subject to the Belgian Freight Forwarding Standard Trading Conditions 2005. The text of those Conditions has been published under number 0090237 in the Annexe au Moniteur Belge dated June 24th, 2005 ( the “General Conditions”).

   The text of the General Conditions has been sent to you by registered mail or will be sent to you free of charge upon first request. The General Conditions are also mentioned on every written offer. Whenever using the services of Flightwatch you are supposed to agree with these General Conditions.

2. All invoices are payable in cash in Ostend.

3. As from the due date date of the invoice, and without any reminder or notice of default, an interest of 12% per annum will automatically start running, until the entire payment has been made.
   On top of that, there will be a fixed compensation of 12% of the amount of the invoice for late payment , with a minimum of € 250.00 .

4. The interest and lump sum compensation shall be payable without prejudice to the applicability of the law of August 2, 2002 (as amended by the Act of November 22, 2013 ) on combating late payment in commercial transactions ( Published in the BS at 08/07/2002 and 10:12 .2013 ) .

5. Any complaint about the invoice must be notified to Flightwatch by registered mail within 5 days after the date of this invoice .

6. Any dispute concerning the carriers , invoices or payments in connection with any transport performance , is subject exclusively to the Courts of the judicial district of Ostend.
